1. Overview & Acceptance
Welcome to Chris Guitar (“we”, “us”, “our”), accessible at chrisguitar.app. Chris Guitar is a personal songbook tool for guitarists: a place to search for songs, save chord charts to your own library, and use AI-assisted tools to help format them for your own practice.
By accessing our website, creating an account, or using our services, you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree with these terms, please do not use the application.
2. Nature of the Service
Chris Guitar is built for guitar. Chord charts, transposition, capo notes, and formatting are designed around guitar playing and practice. References elsewhere to other instruments should be read as guitar-focused unless we say otherwise.
The core of the app is your personal library: songs you have searched for, saved, and arranged for your own use, with the help of our tools. This is not a public chord database that we curate or publish on our own initiative — you direct what gets searched for, saved, and formatted in your account. Any pre-loaded reference charts provided within the app are community study templates intended solely to demonstrate formatting and assist individual rehearsal.
3. Copyright & Fair Dealing
3.1 Ownership of Underlying Works
All original songs, musical compositions, melodies, and lyrics referenced or transcribed on Chris Guitar remain the exclusive intellectual property of their respective songwriters, composers, and publishers. Chris Guitar does not claim ownership or co-authorship over any underlying musical work or lyrics, no matter how the chart was sourced, searched for, or formatted.
3.2 Chord Charts & Personal Transcription
Chord progressions and harmonic structures, as such, are not independently copyrightable. Personal chord charts created, adapted, or refined by a user (including charts built up over years of playing) reflect that user's own transcription effort. This does not transfer, dilute, or override the copyright owner's rights in the underlying lyrics and composition — a personal or long-practiced transcription is still a use of someone else's copyrighted work, not a substitute for a licence to it.
3.3 Fair Dealing Basis
Chris Guitar operates on the basis that saving a chart to your own private library, for your own study and practice, falls within fair dealing for research or private study under Section 40 of the Copyright Act 1968 (Cth). This basis depends on charts remaining personal and non-commercial in substance — we do not sell access to specific songs or lyrics, and paid plans (Section 9) unlock tools, cloud sync, and storage, not copyrighted content itself.
3.4 Your Warranty
By searching for, saving, or formatting a chart through Chris Guitar, you confirm that:
- You are doing so for your own personal practice, accompaniment, or study — not for resale, redistribution, or public performance licensing;
- You are not reproducing entire commercial sheet music publications or instructional books; and
- You are responsible for ensuring your own use of any saved material complies with applicable copyright law.
4. AI-Assisted Search & Formatting Tools
Our AI tools assist you in locating reference charts and formatting them into Chris Guitar's chord layout, based on your own search request. The AI acts on your instruction — it does not independently publish or distribute chord charts as a Chris Guitar product.
AI-generated arrangements are produced algorithmically and may occasionally be inaccurate, misaligned, or incomplete. We continuously refine chord placement and formatting, but we do not warrant that any AI-assisted arrangement will be perfectly accurate. AI tools may also occasionally reproduce portions of source lyrics more closely than intended; you should review saved content and are responsible for how you subsequently use it.
5. Copyright Complaints & Takedown Policy
We respect the rights of songwriters, composers, and publishers. If you are a copyright owner, music publisher, or authorised agent and believe that material accessible on Chris Guitar infringes your copyright, please contact our copyright agent:
Please include: (a) identification of the copyrighted work; (b) the location or URL where the material appears, to the extent you are able to identify it; (c) your contact details; and (d) a statement that you have a good-faith belief the use is not authorised.
✓ Commitment: We aim to review and act on valid complaints — including removing or disabling access to the contested material — within 1–2 business days.
6. User Accounts & Responsibilities
You may register using Google, Apple, or your email address. You agree to:
- Provide accurate information and keep your credentials confidential;
- Promptly notify us if you detect unauthorised access to your account;
- Never use automated bots, scrapers, or data miners to mass-harvest charts from the application; and
- Not attempt to disrupt, reverse-engineer, or compromise the platform's security or infrastructure.
7. Eligibility
You must be at least 13 years old to create an account. If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these terms on your behalf where required by law.
8. Your Content & Licence to Us
When you save, format, or store a chart in your library, you grant Chris Guitar a non-exclusive, royalty-free licence to host, format, transpose, and display that content back to you, solely to provide the service to your account. We do not claim ownership of your personal arrangements, and — unless you have indicated otherwise — we do not make your saved library visible to other users.
9. Plans, Subscriptions & Free Trial Terms
Chris Guitar offers the following tiers (see our Pricing Page for current details):
- 14-Day Free Trial: Annual ChordPro+ subscriptions include a 14-day free trial. You may cancel at any time within the 14 days without charge.
- Billing & Auto-Renewal: Subscriptions automatically renew at the end of each billing period (monthly or annually) unless cancelled before the renewal date.
- Cancellation: You can cancel at any time through your Account settings or customer portal. When cancelled, premium benefits remain active until the end of the current billing cycle.
- Refunds & Australian Consumer Law: Subscriptions are billed in advance. Our services come with guarantees under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded. Nothing in these terms limits your non-excludable statutory rights.
10. Availability & Disclaimers
Chris Guitar is provided on an “as is” and “as available” basis. While we use uptime monitoring and error tracking, we do not guarantee the service will be uninterrupted, error-free, or compatible with every browser or device.
11. Limitation of Liability
To the maximum extent permitted by applicable Australian law, Chris Guitar and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your access to, or inability to use, the platform. Nothing in this clause limits any liability that cannot lawfully be excluded, including under the Australian Consumer Law.
12. Indemnification
You agree to indemnify and hold Chris Guitar harmless from any claims, damages, or expenses (including reasonable legal fees) arising from content you submit or save, or your breach of these terms, to the extent permitted by law.
13. Suspension & Termination
We may suspend or terminate your account if we reasonably believe you have breached these terms, misused AI tools to mass-harvest or redistribute copyrighted material, or infringed a third party's rights. You may close your account at any time through Account settings.
14. Fair Contract Terms & Changes to Terms or Pricing
In strict adherence to the Australian Consumer Law (ACL) and Australian Competition and Consumer Commission (ACCC) guidance on unfair contract terms:
- No Detrimental Unilateral Changes: We do not claim or reserve any unilateral right to alter subscription prices, core platform features, or these terms to your detriment without fair advance notice and your affirmative agreement.
- 30 Days Advance Written Notice: If we propose any material alteration to these terms, subscription pricing, or service offerings, we will provide at least 30 days advance written notice via email to your registered account and through a prominent in-app notification before changes become effective.
- Right to Cancel Without Penalty: If you do not accept a proposed material change or price variation, you retain the unrestricted right to cancel your subscription or delete your account at any time prior to the effective date with zero cancellation fees, exit penalties, or loss of existing accrued data.
- Affirmative Re-Acceptance: Where material changes affect your rights, subscriptions, or privacy, we will seek your affirmative re-acceptance (via an explicit confirmation prompt upon your next sign-in) rather than assuming silent or deemed consent.
15. Privacy
Our Privacy Policy explains what information we collect (including account details and saved library content) and how we use it. It forms part of these Terms & Conditions by reference.
16. Severability
If any provision of these terms is found unenforceable, the remaining provisions will continue in full force and effect.
17. Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes are subject to the non-exclusive jurisdiction of the courts of New South Wales.
